My counseling integrates business and project consulting, transactional drafting, risk management advice, and early dispute resolution. This includes experience in construction phase consulting, project close-out, mechanic’s liens and alternative dispute resolution proceedings. When necessary, I can assist with mediating or litigating construction matters such as non-payment actions, contract disputes, construction liens, delay claims, and related legal actions.

  • Development and preparation of RFPs (including evaluation of responses to RFPs);

  • Drafting and negotiating design contracts, consulting agreements, AIA construction contracts, and related agreements;

  • Review of and counseling on project requirements (e.g., special work rules; integration with lease, lender requirements; integration of insurance requirements; bonding; etc.);

  • Project monitoring and counseling (e.g., for interim dispute and change order resolution);

  • Assisting in the selection of appropriate development and construction project delivery methods;

  • Preparation of project close-out agreements (under amicable or adversarial conditions);

  • Drafting and negotiating adjoining property licenses and access agreements;

  • Claim evaluation and counseling, including mechanics' liens, warranties, and delay and other “impact” claims; and

  • Representation in alternative claim resolution procedures and construction litigation.
